Since the Nuremberg trials (1947–1949), informed consent has become central for ethical practice in patient care and biomedical research. Codes of ethics emanating from the Nuremberg Code (1947) recognize the importance of protecting patients and research subjects from abuses, manipulation and deception. Informed consent empowers individuals to autonomously and voluntarily accept or reject participation in either clinical treatment or research. In some cases, however, the underlying mental or physical condition of the individual may alter his or her cognitive abilities and (...) compromise the informed consent process. This is particularly true in chronic psychiatric conditions such as Treatment-Resistant Depression (TRD), where individuals may fail to respond to traditional antidepressant treatments (e.g., psychotherapy, pharmacotherapy). Moreover, it may raise further concerns for an individual’s motivation to consent and the level of understanding of the treatment or research procedure. This paper focuses on the informed consent process for Vagus Nerve Stimulation (VNS) in the treatment of individuals diagnosed with TRD. Specifically, the paper addresses how depression may affect the decision-making capacity of an individual and the potential ethical and legal impact of failure to appreciate the seven elements of the consenting process (competence, voluntariness, disclosure, recommendation, understanding, decision, and authorization). To ensure the protection of vulnerable individuals with psychiatric disorders such as TRD and promote ethical behavior in biomedical research and patient care while avoiding potential legal pitfalls, we propose a paradigm that requires a stringent evaluation process of decision-making capacity for informed consent. In his recently published Donner le temps II, Derrida raises, but does not develop, the possibility that Heidegger's notion of Gelassenheit (‘releasement’, ‘letting-be’) might escape the economic confines of exchange, debt, and repayment and therefore qualify as a pure gift. In this paper, I explore this possibility, explaining that Gelassenheit would have to be understood, first, not primarily as a human comportment but at the level of being itself, second, beyond appropriation, and third, as ‘without why’. If Heidegger's focus on (...) appropriation in ‘Time and Being’ remains entangled in the economy of exchange (as Derrida insinuates in the final session of Donner le temps II), Heidegger's anarchic treatment of ‘letting’ ( laisser, Lassen) in the final session of his 1969 seminar in Le Thor opens instead onto a ‘pure giving’ ( pur donner, reines Geben). Translators’ Abstract: In this introduction to his Italian translation of Reiner Schürmann’s, Gianni Carchia offers a short yet incisive interpretation of the compelling originality of Schürmann’s reading of Heidegger. Carchia points out that, contrary to much Heidegger literature, Schürmann insists on a three-tiered temporal difference rather than on a simple dichotomy between beings and being as the driver of the deconstruction of metaphysics, and it is only through this distinction that the an-archic as the evental and ahistorical origin of being (...) comes into view. What this displacement affords is a certain historicization of Heideggerian philosophy that brings out the anarchic, polymorphous, and protean nature of being and restores to acting its spontaneity and innocence. Observing that this anti-humanist naturalization of an-archy may indeed be closer to Eugen Fink’s cosmology, which grants autonomy to the extra-human, than to Heidegger’s history of Dasein, which confines us to “the prison of the human,” Carchia locates the contribution of Schürmann’s work in its deconstruction of the Idealist remnant in Heidegger. My premise is that a transmasculine experience of embodiment haunts the subject of The Second Sex. In light of her early philosophical essay on Claude Bernard, Beauvoir's account of sex difference may be read as the biological experience of “error” that foils what biopolitics and early twentieth‐century knowledge in the life sciences wanted to make of her. I argue that from this perspective the crucial discussion of the endocrine system of the human female in the Biology chapter adds a new (...) twist to the medical and scientific discourses for understanding transsexual identification. Objective Adolescents have had very limited access to research on biomedical prevention interventions despite high rates of HIV acquisition. One concern is that adolescents are a vulnerable population, and trials carry a possibility of harm, requiring investigators to take additional precautions. Of particular concern is preventive misconception, or the overestimation of personal protection that is afforded by enrolment in a prevention intervention trial. Methods As part of a larger study of preventive misconception in adolescent HIV vaccine trials, we interviewed 33 (...) male and female 16–19-year-olds who have sex with men. Participants underwent a simulated HIV vaccine trial consent process, and then completed a semistructured interview about their understanding and opinions related to enrolment in a HIV vaccine trial. A grounded theory analysis looked for shared concepts, and focused on the content and process of adolescent participants’ understanding of HIV vaccination and the components of preventive misconception, including experiment, placebo and randomisation. Results Across interviews, adolescents demonstrated active processing of information, in which they questioned the interviewer, verbally worked out their answers based upon information provided, and corrected themselves. We observed a wide variety of understanding of research concepts. While most understood experiment and placebo, fewer understood randomisation. All understood the need for safer sex even if they did not understand the more basic concepts. Conclusions Education about basic concepts related to clinical trials, time to absorb materials and assessment of understanding may be necessary in future biomedical prevention trials. (shrink)

In the field of business and society, several complementary frameworks appear to be in competition for preeminence. Although debatable, the primary contenders appear to include (a) corporate social responsibility, (b) business ethics, (c) stakeholder management, (d) sustainability, and (e) corporate citizenship. Despite the prevalence of the five frameworks, difficulties remain in understanding what each construct really means, or should mean, and how each might relate to the others. To address the confusion, the authors propose three core concepts—value, balance, and accountability—that (...) might be used to better integrate the five frameworks and potentially provide the basis for further discussion and theoretical development of the business and society field. We know from the research literature that psychotherapy is effective, but we also know that hundreds of diverse therapies are being practiced that have not been subjected to scientific scrutiny; thus, in some circumstances iatrogenic effects do occur. Therefore, it is crucial that we recognize and implement therapeutic interventions that are evidence based rather than succumb to ethical dilemma, frustration, and complacency. Recommendations for family therapists are discussed, including the need to (a) keep abreast of research findings, (b) translate research (...) findings and developments as they apply to clinical practice, (c) prioritize techniques and intervention models, and (d) reexamine funding priorities and research foci. Phosphotyrosine phosphatases (PTPases) are the enzymes which remove phosphate groups from protein tyrosine residues. An enormous number of phosphatases have been cloned and sequenced during the past decade, many of which are expressed in haematopoietic cells. This review focuses on the biochemistry and cell biology of three phosphatases, the transmembrane CD45 and the cytosolic SH2‐domain‐containing PTPases SHP‐1 and SHP‐2, to illustrate the diverse ways in which PTPases regulate receptor signal transduction. The involvement of these and other PTPases has been demonstrated (...) in haematopoietic cell development, apoptosis, activation and non‐responsiveness. A common theme in the actions of many haematopoietic cell PTPases is the way in which they modulate the thresholds for receptor signalling, thereby regulating critical events in the positive and negative selection of lymphocytes. There is growing interest in haematopoietic PTPases and their associated regulatory proteins as targets for pharmaceutical intervention and in the involvement of these enzymes in human disease. Ethicists, researchers and policy makers have paid increasing attention to the ethical conduct of research, especially research involving human beings. Research performed with and by undergraduates poses a specific set of ethical challenges. These challenges are often overlooked by the research community because it is assumed that undergraduate student researchers do not have a significant impact on the research community and that their projects are not host to research posing important ethical issues. This paper identifies several features characteristic of research (...) in undergraduate environments. The paper pays special attention to selective small liberal arts colleges, an important segment of higher education in the US, and advocates integrating instruction in research ethics wherever undergraduates are engaged in research. For Protosociology the "Diskurs "-theory has a special significance. Validity-dimensions of speech and their evaluation in the procedure of argumentation indicate generalized presuppositions of interactive processes. These validity-dimensions can be reconstructed in lingusitic characterisations of "normative language" (P.W. Taylor). Thus it is possible to make first steps to a theory of validity. Protosociology provides a special reconstruction of argumentative speech on the level "interpersonality, structure of communicative acting and collective identity". The aim of Protosociology within a context of problems of (...) "Diskurs"-theory would have to establish normative values for an evaluation of such validity-dimensions. A logic of "Diskurs" would have to be developed as a kind of logic of "relevance". (shrink)

Can we have a posteriori knowledge of modal facts? And if so, is that knowledge fundamentally a posteriori, or does a priori intuition provide the modal component of what is known? Though the latter view seems more straightforward, there are also reasons for taking the first option seriously.

This commentary explores biological models of analogical and associative learning in support of Illusion 1 and Illusion 4 in D. Noble’s target article. The intent is to support Noble’s theses of emergent higher level functionality from lower level stochastic dynamics and his etiological claim that “there is no privileged level of causation” through a biosemiotic lens. Upon these arguments, a case for creative agency via higher-dimensional constraints will also be made in support of Noble’s claim that organismic behavior is actively (...) directed by an agent. Metaphors involve immense explanatory power and positive impact predominantly in the scientific education and popularization. Still the use of metaphors in science might be a double-edged sword. Introduction of the computer metaphor to many scientific fields in the last century resulted in reductionist approaches, oversimplifications and mechanistic explanations in science as well as in humanities. In this short commentary we developed further the computer metaphor by prof. Noble and the illusions this metaphor led to in genetics, linguistics and consequently DNA (...) linguistics. (shrink)

For the last 30 years there have been debates in philosophy about the concept of rationality. In anglo-american circles they have been primary characterized as discussions about “justified beliefs.” By contrast, the debate in Germany among discourse-theorists (Habermas, Apel) has been linked to the problem of justification of communicative speech-acts (within the concept of the entire communicative situation). Herbert Schnädelbach has modified the discours-theoretical account. His concept can be regarded along a number of dimensions. He has developed a linguistic analysis (...) of the validity claims made in various speech-act situations (following Paul Taylor). In Schnädelbach’s view, normative characterizations of speech acts can be used descriptively, too. Furthermore, the hierarchy of justifications ends on the level of rational choice.My starting point here is: there is a fundamental distinction between justifications in everyday-life and a theoretical level of justification (discoursive justifications). Thus, I discuss the hierarchy of justifications developed by Schnädelbach.Furthermore, I evaluate Schnädelbach’s concept in a semantic perspective. I will show that Schnädelbach’s pragmatical account requires a semantic analysis. Without recourse to such analysis, we cannot understand the universe of normative language. (shrink)

Nonmonotonic reasoning is a theory of the rational use of assumptions. We describe the relations between NMR and Logic, and two main paradigms of NMR, preferential and explanatory one.

What is the nature of our reasons for loving something? Why does a particular person or activity stimulate our imagination and hopes more deeply than others do? Is the reason in the object of our affection or in ourselves? Much philosophical debate revolves around this dichotomy between objective and subjective reasons for loving. In this paper I will instead propose that our reasons are primarily relational, having to do with the concept of affinity. Affinity, defined as “fitness” between two parties, (...) allows us to analyze loving activity in terms of a practical inference concerned with a long-term engagement in activities and relationships that are worthwhile and suitable to oneself. This approach does justice to the considerations on both sides of the debate. (shrink)

Interest in esoteric and mystical aspects of Islam in present-day Russia and its Soviet and tsarist predecessors is a complex and multifaceted phenomenon. The article starts with a critical discussion of Aleksandr Dugin’s interpretations of Sufism in his ambitious intellectual project Noomachia: Wars of the Intellect [and] Civilizations of Borderlands. The author then compares Dugin’s conceptualizations of Sufism with those of several Russian writers who lived in the second half of the nineteenth century and whose portrayal of Sufism and its (...) followers is similar to Dugin’s in some important respects. These ideologically driven constructions of Sufism stand in sharp contrast to the self-consciously objective scholarly ones that emerged in the late nineteenth/early twentieth century within the Russian academic and teaching institutions specializing in Eastern religions, languages, and cultures. The author argues that Russian academic conceptualizations of Sufism mirrored those of the fin-de-siècle German Islamology and then proceeds to examine the profound changes in Russian attitudes to Sufism, and Islam generally, after the Bolshevik Revolution of 1917 and the rise of the Soviet state that based its legitimacy on the Marxist-Leninist concept of history with its pervasive atheism, materialism, and emphasis on class struggle. It shaped Soviet-era academic and nonacademic approaches to Sufism until the mid-1980s, when Soviet scholars began to question the Marxist-Leninist certainties of the previous six decades. (shrink)

Sender–receiver games, first introduced by David Lewis ([1969]), have received increased attention in recent years as a formal model for the emergence of communication. Skyrms ([2010]) showed that simple models of reinforcement learning often succeed in forming efficient, albeit not necessarily minimal, signalling systems for a large family of games. Later, Alexander et al. ([2012]) showed that reinforcement learning, combined with forgetting, frequently produced both efficient and minimal signalling systems. In this article, I define a ‘dynamic’ sender–receiver game in (...) which the state–action pairs are not held constant over time and show that neither of these two models of learning learn to signal in this environment. Dado el carácter intencional de las variables explicativas de la Teoría Económica y el papel de la información al realizar una elección, se argumenta que es improbable que (...) dicha Teoría pueda garantizar el poder predictivo, que le permitiría funcionar corno teoría factual en vez de corno teoría normativa.I defend the integrity of the question of what the cognitive status of economic theory could amount to, and I argue that the theory is best understood as a compartment of formal political philosophy, in particular a species of contractarianism. This seems particularly apt as an account of general equilibrium theory. Given the intentional character of the explanatory variables of economic theory and the role of information in effecting choice, it is argued that economic theory is unlikely to secure the predictive power that would enable it to function as a factual instead of a normative theory. This chapter examines historical reconstruction and literary structures of rabbinic texts using the Leviticus Rabbah as an example. It explains that Leviticus Rabbah is a commentary on the Book of Leviticus which now forms part of Midrash Rabbah. It proposes ten theses about the special problems which the literary structures of rabbinic texts pose for the historian and analyses a section of the amoraic work of Leviticus Rabbah to describe some of those literary structures. The findings suggest that it is (...) impossible to explain how the textuality of rabbinic sources worked and that many rabbinic works fill the same functional position in a text more than once. The prevalence of ethics training in organizations rose from 50% in 2003 to 76% in 2011 (Ethics Resource Center 2012). This paper reviews the current state of ethics training in organizations and proposes a new conceptual model for designing effective ethics training programs based on Rest’s (1986) model of ethical decision-making. We argue that it is not the content of ethics training that fails to produce ethical behavior; it is the method by which ethics training is delivered. Most organizations utilize (...) training methods designed to disseminate information or facilitate ethical dilemma recognition. Few organizations utilize methods that allow for trainees to actually practice making an ethical decision. We argue that a comprehensive approach to ethics training should be used, so trainees may practice all aspects of making an ethical decision. This practice should then enhance transfer of ethics training to the job. We conclude with suggestions for how research could be conducted to empirically support these arguments and inform ethics training method choices. (shrink)

The first part of this essay discusses certain aspects of current research dealing with historical theories of emotions as well as with historical (fictional and non-fictional) descriptions of emotions; trends in medieval philology that apply a vague concept of social constructionism to emotions are criticised. The second part attempts to provide some historical background in regard to the question of the location of anger within medieval faculty-based psychology. The third and fourth parts focus on the medieval conception of anger as (...) a specifically “moral” – and therefore human – emotion straddling the border between the animal and spiritual world. The author considers the thesis about the opposition between the universal (philosophy of science) and particular (history of science), and about the retreat of epistemology in their juxtaposition to the transformations in contemporary philosophy during last decades and its links to science studies.           Despite the fact that the strength of argument is clearly on the pro-life side—nobody except a handful of academics would question the grave wrongness of abortion were pregnancy never inconvenient—somehow ordinary intelligent people, like our students, often remain unconvinced. There are many reasons for this, of course. For instance, a number of students have had their children aborted while many know others who have had abortions, and one does not want (...) to condemn oneself or oneÂ’s friends. I am a philosopher, however, and so I will be interested in intellectual reasons, even though these subjective psychological ones are almost surely more important. Specifically, I will be interested in the fact that the ordinary person subscribes to a number of erroneous big-picture ethical beliefs, each of which, to a different degree, does something to block access to the pro-life arguments. I will not talk about all such erroneous beliefs and I would be grateful in the discussion for more examples.           I will talk about eight errors I have identified, largely through teaching. For each one, I will identify the error, show how it impacts the pro-life message and explain why it is tempting to most of us —there is, after all, something right about five of the errors. For each of these errors is one that we might ourselves be tempted by on occasion. I will then suggest some ways of refuting the error. In some cases, the mere identification of the error should do the trick, as these erroneous beliefs are often not explicitly identified by our interlocutors. My suggested refutations will not always be phrased in the way in which I would phrase them for didactic effectiveness: in this talk, I am mainly trying to convey ideas. A recombinationist like the earlier Armstrong (1989) claims that logically possible worlds are recombinations of items found in the actual world, with some items reduplicated if need be and others deleted. An immediate consequence of this is that if an alien property is a property that could only be defined in terms of fundamental properties that are actually uninstantiated, then it is logically impossible that an alien property be instantiated as no recombination of the items in the actual world can (...) yield a world with an entity having such a property. Recombinationism immediately implies that S5 is false. To see this, suppose for simplicity, as I will throughout this paper, that electric charge is a fundamental property--otherwise, a different example would have to be used. Then, let w be a possible world lacking any charged objects. At w, then, it is true that it is logically impossible that there be a charged particle since no recombination of the entities in w yields a charged particle. Therefore, contrary to S5, what is possible at w differs from what is possible at the actual world, since charged particles are actual and hence logically possible at the actual world. While this argument may make one sceptical of recombinationism, the recombinationist will say that it is not surprising that if we follow out the Aristotelian intuition that possibility is to be grounded in actually existing entities, then what is possible will depend on what is actual. Henceforth I will no longer assume S5, and so logical possibilities will have to be relativized to worlds if recombinationism is true: it is logically possible at the actual world for charged particles to exist, but at a world at which there are no charged particles it is logically impossible for charged particles to exist... An explanation of the inter-gender difference in longevity consistent with the 'disposable soma' theory of ageing is proposed. It is based on the concept of r-K selection as applied to the inter-gender situation. The concept predicts that the gender with a higher potential reproductive rate (males) should invest relatively less in somatic maintenance, which in its turn should result in a lower longevity according to the 'disposable soma' theory of ageing. In females, which are interpreted as K-selected organisms, the reproductive (...) strategy strongly depends on steady, secure constitution designed for oocyte/embryo bearing and is therefore closely related to somatic maintenance, whereas in (r-selected) males it has a greater behavioural component - risky, variable, with a greater potential reproductive success at the expense of somatic maintenance. The higher metabolic and growth rates, a higher premature mortality and a longer period of sexual competence of males also find explanation as a complex of r-selected traits. (shrink)

Excerpt from The Dynamic Foundation of Knowledge It is now a long time since the writer of the following pages first thought of a dynamical interpretation of the concept of Matter. After some years of consideration and discussion he expressed his views in print in an essay entitled Matter and Energy: Are there two Real Things in the Physical Universe? This essay was published in 1887. A second essay was published in 1897 under the title, The Doctrine of Energy: A (...) Theory of Reality. Biological mimicry is regarded by many as a textbook illustration of Darwin’s idea of evolution by random mutation followed by differential selection of reproductively fit specimens, resulting in gradual phenotypic change in a population. In this paper, I argue that some cases of so-called mimicry are probably merely look-a-likes and do not gain an advantage due to their similarity in appearance to something else. In cases where a similar appearance does provide a benefit, I argue that it is possible that (...) these forms of mimicry were created in a single generation. An interpretive response to an appearance as a sign can make a new structure perform drastically differently in an environment. In such cases, Darwin’s natural selection mechanism only helps to explain gradual the spread of these new forms, not the creation of them. I argue that biosemiosis should be regarded as a much more powerful mechanism for affecting evolutionary trajectories than the gradualist view allows. I focus on two cases of butterfly mimicry: the Viceroy (Nymphalidae: Limenitis archippus) and Monarch (Nymphalidae: Danaus plexippus) butterflies, supposed Müllerian mimics, and deadleaf mimic butterflies (Kallima).
